Mong Kok - Break the law and get an environmental exemption

PRESS RELEASE – 15 January 2009

The rule of Law in Hong Kong is at risk. In the Legislative Council this week, the Environmental Protection Department is proposing that drivers who are breaking the law should get exemptions for the proposed idling engine law. Here is the list:

Road Traffic Ordinance (Cap 374)

Sec: 14(7) - Loading/unloading goods in restricted zone $450
Sec: 35(1)(a) - Driver of first or second public light bus at public light bus stand leaving vehicle $320
Sec: 35(1)(b) - Driver of first or second public light bus at public light bus stand not ready/ willing to drive from public light bus stand $320
Sec: 35(2)(a) - Public light bus driver not moving forward at public light bus stand $320
Sec: 35(2)(b) - Public light bus obstructing other public light bus at public light bus stand $320
Sec: 45(1)(h) - Stopping public bus, public light bus or taxi longer than necessary when picking up/setting down passengers $320

Sec: 44 - Vacating a motor vehicle - No person in charge of a motor vehicle on a road shall vacate the vehicle without having stopped the engine except where the vehicle is designed so that the engine is used for purposes other than the propulsion of the vehicle and the driver is in attendance.

Cap 237 Sec 4 Obstruction on roads by motor vehicles. No person shall cause or permit any motor vehicle to stand on a road in such a position or in such condition or in such circumstances as to be likely to cause any unnecessary obstruction of such road or danger to other persons using the road.

44 離開汽車及開啟車門 任何掌管在道路上的汽車的人，不得在以下情況離開車輛 未有將引擎停止凡車輛經設計以使其引擎用於驅動車輛以外的其他用途，且有司機看守，則(a)段不適用
章237條4 汽車對道路所造成的障礙任何人均不得致使或允許任何汽車停放於道路上，以致該汽車停放的位置，或在當時的情形或情況下，相當可能對該道路造成不必要的障礙，或對其他使用該道路的人造成不必要的危險
